Sounds like this 'solves the orphan problem' primarily for those who wish to use a piece of work without the bother of paying the person who actually went to the trouble of producing it. One could use an image without credit or payment merely after googling a few general keywords, without making a truly serious attempt at tracking down the artist. Surely the arts are a tough enough place to make any money at all, without making it easier to be ripped off.
Certainly, this is very poorly thought out piece of legislation.
