And wasn't John McCain a serving officer when he took out a marriage license for his second wife while still married to the first?

I really used to like McCain, but this is almost as bad as Newt Gingrich telling his first wife that he was dumping her while she was in the hospital recovering from a mastectomy.

Applying for a marriage licence while still married - it sounds perilously close to bigamy, but I'm not a solicitor...

It is odd. I would think you'd have to show finalized divorce decrees or death certificate if you check the little "previously married" box. After all, I recall having to show my birth certificate and current ID to prove identity.

And (a) does this invalidate the licence, and assuming they married under it rather than a second one issued later,

(b) are they actually married?

I'm pretty sure that in the UK you would have to show the divorce certificate if you're remarrying, but then I have never got married or divorced, so I'm not sure.

Well, if they just got the license, but didn't officially marry until the divorce was final, I suppose it's still legal. But different states have different laws, so who knows?
